What happened

The Landlord applied to terminate the tenancy and evict the Tenant due to significant rent arrears. During the hearing, the parties reached a consent agreement. The total arrears calculated to July 31, 2025, were $38,289.20, but the claim was capped at the LTB's maximum monetary jurisdiction of $35,000.00. The parties agreed to a structured payment plan for the arrears and the August rent.

The ruling

The LTB issued a consent order establishing a payment plan for the Tenant to pay $35,186.00 in arrears and costs. The Tenant must pay $2,000.00 monthly starting October 15, 2025, for 17 months, plus a final payment of $1,186.00. Additionally, current rent must be paid on time. Failure to meet any payment allows the Landlord to apply for an ex-parte eviction order within 30 days of the breach.
