What happened
The Landlord applied for rent arrears after the Tenant vacated the rental unit early. The Tenant provided an N9 notice to terminate a fixed-term tenancy effective July 1, 2025, but the lease agreement was set to expire on September 1, 2025. The Tenant moved out on June 28, 2025. A dispute occurred regarding the amount of rent deposit paid, with the Tenant claiming a significant cash payment that the Board found unsubstantiated. The Landlord successfully mitigated losses by finding a new tenant for July 26, 2025.
The ruling
The Tenant is ordered to pay the Landlord $729.17 by September 8, 2025. This amount represents rent arrears and daily compensation up to the date the Landlord re-rented the unit, plus the application fee, minus the rent deposit and interest held by the Landlord. The Board rejected the Tenant's claim of an additional cash deposit due to lack of proof.
