What happened
The Tenant filed a motion to set aside an eviction order after paying the full amount of rent arrears and associated costs required to void the order under the Act. While the arrears and initial filing fees were paid, the Landlord had already incurred non-refundable sheriff enforcement costs which the Tenant had not yet reimbursed.
The ruling
The eviction order LTB-L-009310-25 is declared void provided that the Tenant pays the $330.00 sheriff enforcement costs to the Landlord on or before August 31, 2025. If the Tenant fails to make this payment by the deadline, the eviction order will become enforceable.
