What happened

The Tenant applied for an order determining that the Landlord collected or retained money illegally. The Tenant sought to assign her lease due to safety concerns and her work schedule. After the Landlord refused the concept of assignment and threatened legal action, the Tenant served an N9 notice. The Landlord failed to refund the prorated portion of the last month's rent deposit and the key deposit after the Tenant vacated the unit.

The ruling

The Landlord is ordered to pay the Tenant $1,733.08 by December 15, 2025. This total includes $1,485.08 for the remainder of the last month's rent deposit, $200.00 for the key deposit, and $48.00 for the application filing fee. The Tenant successfully argued that she was entitled to terminate the tenancy early because the Landlord refused her request to assign the lease.
