What happened
Landlords applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant requested an adjournment to raise issues under Section 82 of the Residential Tenancies Act, but this was denied as the Tenant did not provide the required notice and evidence. The Tenant was still in possession of the rental unit at the time of the hearing.
The ruling
The tenancy is terminated unless the Tenant pays $13,841 by September 30, 2023 to void the order. If the Tenant does not pay, the Tenant must move out by September 30, 2023 and pay $10,146.40 to the Landlords. The Tenant will also owe daily compensation of $47.80 for each day of occupation starting August 15, 2023.
