What happened

The Landlord applied to terminate the tenancy and evict the Tenant due to substantial rent arrears. A key issue arose regarding a rent increase which the Member found to be unlawful as 12 months had not passed since the previous increase. Furthermore, the Tenant failed to comply with an interim order to pay rent on time, leading the Board to refuse to consider the Tenant's section 82 issues to avoid an abuse of process.

The ruling

The tenancy is terminated effective June 1, 2025, unless the Tenant voids the order by paying $12,486.00 by May 31, 2025 (or $13,511.00 by June 1, 2025). If the Tenant does not void the order, they are ordered to pay the Landlord $10,821.76 for arrears and filing costs, plus daily compensation of $33.70 until they vacate.
