What happened
The Tenant (mother) applied for an order against the Landlord (son) alleging he changed the locks without providing keys. The Board investigated whether a residential tenancy actually existed. The Tenant claimed she lived at the property in exchange for waiving interest on a $35,000 loan she allegedly provided to the Landlord. The Adjudicator found the Tenant's testimony inconsistent and determined the matter was a family dispute over property and debt, falling outside the jurisdiction of the LTB.
The ruling
The application is dismissed. The Board found that the relationship between the parties was that of a family dispute over debt and property ownership rather than a landlord-tenant relationship. As a result, the LTB has no jurisdiction. An interim order previously issued was cancelled.
