What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit at the time of the hearing.
The ruling
The tenancy shall continue, subject to the Tenant paying off the arrears of $9,111 in monthly installments of $1,100 from January 22, 2025 to August 22, 2025, and $311 on September 22, 2025. The Tenant shall also pay the rent in full and on time, commencing February 1, 2025 to September 1, 2025. If the Tenant fails to make the payments, the Landlord may apply to the LTB for an order terminating the tenancy and evicting the Tenant.
