What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to significant rent arrears. The Tenant disputed the rent due date, claiming a verbal agreement to move it from the 15th to the 21st of the month, which the Landlord denied. The Tenant also attempted to raise issues regarding the tenancy under section 82 but was barred for failing to provide the Landlord with the required advance notice and evidence.
The ruling
The tenancy is terminated effective October 21, 2025, unless the Tenant voids the order by paying $19,586.00 by October 14, 2025 (or $22,286.00 by October 21, 2025). If the Tenant does not void the order, they are ordered to pay the Landlord $14,195.62, which represents arrears up to the hearing date plus the filing fee, minus the rent deposit and interest. The Tenant must also pay $88.77 per day in compensation from September 16, 2025, until they vacate.
