What happened
The Landlord initiated eviction proceedings against the Tenant for non-payment of rent. The Tenant appealed the Landlord and Tenant Board's eviction order to the Divisional Court. The Landlord moved to quash the appeal on the basis that it did not raise a question of law and was devoid of merit.
The ruling
The court quashed the Tenant's appeal of the Landlord and Tenant Board's eviction order. The court found that the appeal did not raise any questions of law and was an attempt to introduce new factual issues not raised before the Board. The stay of the eviction order was lifted, and the Sheriff was directed to enforce the eviction order immediately. The Tenant was ordered to pay $4,000 in costs to the Landlord.
