What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant, who has lived in the unit since 2017, experienced significant personal and financial hardship following the death of a daughter and the subsequent legal costs to gain custody of a grandchild. The Tenant requested a payment plan, but the Landlord opposed this, citing a history of persistent late payments. The adjudicator determined that despite the tragic circumstances, the Tenant's history of delinquency made it unfair to grant relief from eviction.

The ruling

The tenancy is terminated effective November 11, 2025, unless the Tenant voids the order by paying the arrears. To void the order by October 31, 2025, the Tenant must pay $8,539.70. If the Tenant does not void the order, they must vacate by November 11, 2025, and pay the Landlord $4,024.31, plus daily compensation of $60.72 until they move out.
