What happened

The Tenants applied for an order determining that the Landlords failed to meet maintenance obligations. Specifically, a toilet in the primary bedroom ensuite was non-functional from March 2, 2024, until the end of the tenancy on May 27, 2024. The Landlords claimed they lacked access to the unit, suggesting the locks had been changed, but the Tenants provided evidence that they had not changed the locks and had left a key for the Landlords at the building's front desk. The Board found the Landlords' delay in repairing the toilet was unreasonable.

The ruling

The Landlords are ordered to pay the Tenants a total of $498.00 by December 14, 2025. This includes a $450.00 rent abatement for the non-functional toilet and the $48.00 application filing fee. If payment is not made on time, interest will accrue at a rate of 4% per annum.
