What happened

Tenant appealed LTB eviction order for non-payment of rent. Tenant claims unit is uninhabitable and has not paid rent since December 2018. Landlord seeks to regain possession of unit and recover rent arrears.

The ruling

The court ordered the tenant to pay $1500 by January 22, 2021 and $1500 monthly thereafter to maintain the stay of eviction pending appeal. The landlord is allowed to re-enter the unit but not re-lease it. If the tenant fails to make payments, the landlord can request termination of the stay and permission to re-lease the unit.
