What happened
The Tenant requested a review of an eviction order issued for non-payment of rent. The underlying issue was that the Tenant continued to pay rent to the former landlord after the property changed ownership due to a mortgage default. The Tenant argued they were not able to participate fully in the original hearing and had new evidence. The Board denied the review, finding that the Tenant had a fair opportunity to participate, the proposed evidence was not 'fresh evidence', and that there was no serious error in the original decision which found the Tenant should have been paying the new Landlord.
The ruling
The Tenant's request to review order LTB-L-014815-25, which was issued on May 28, 2025, is denied. The Board found no grounds for the review, determining there was no serious error and that the Tenant had been afforded procedural fairness. The original order is confirmed and remains unchanged.
