What happened
Landlord applied for an order to terminate the tenancy and evict the Unauthorized Occupant, Kristen Shipman, because the Tenant, Kevin Byerley, transferred occupancy of the rental unit to her without the Landlord's consent. The Landlord also applied for compensation from the Unauthorized Occupant for the use of the rental unit.
The ruling
The Landlord's application is granted. The tenancy between the Landlord and the Tenant is terminated as of February 28, 2023, the date the Tenant moved out. The Unauthorized Occupant, Kristen Shipman, shall move out of the rental unit on or before September 23, 2024. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office (Sheriff) to enforce the eviction. The Unauthorized Occupant shall pay the Landlord $16,832.97 in daily compensation for the use of the rental unit from March 1, 2023 to August 20, 2024, and an additional $31.23 per day from August 21, 2024 until the date they move out. The Unauthorized Occupant shall also pay the Landlord $201.00 for the cost of filing the application.
