What happened
The Landlord applied to terminate the tenancy due to the Tenants' persistent late rent payments. The Tenants had paid rent late 7 out of 12 times in 2024. At the hearing, the Landlord's representative noted the Tenants were not in arrears and suggested a conditional order for them to pay on time. The Member granted relief from eviction based on the Tenants' 6-year tenure and the view that late payment is a minor issue.
The ruling
The Landlord's application to evict the Tenants for persistent late payment is denied on the condition that the Tenants meet the terms of the order. The Tenants must pay their full monthly rent on or before the first business day of each month for 12 consecutive months. If they fail to comply, the Landlord can apply for eviction under section 78 without notice. The Tenants must also pay the Landlord $186.00 for the application filing fee.
