What happened

The Landlord applied to terminate the tenancy for personal use, stating they and their spouse require the unit for residential occupation. The Tenants disputed the good faith of the application, suggesting it was an attempt to obtain market rent, and requested an adjournment which was denied. There were also outstanding rent payments for several months during the process.

The ruling

The LTB ordered the termination of the tenancy effective January 31, 2026, based on the Landlord's good faith requirement for personal use. The Tenants are ordered to pay the Landlord $4,201.45, representing unpaid daily compensation for use of the unit minus the rent deposit and interest. The Landlord was granted an extension to pay the statutory one-month compensation to the Tenants because the Tenants had previously frustrated delivery.
