What happened

The Tenants filed a T5 application alleging that the Landlord issued a notice of termination in bad faith. The LTB issued an order on March 26, 2025, finding in favor of the Tenants because the Landlord failed to reside in the rental unit for the required one-year period after the eviction. The Landlord requested a review of that order, alleging procedural errors and challenging the Member's findings regarding the necessity of his early relocation.

The ruling

The Landlord's request for a review of the March 26, 2025 order is denied. The original order, which found the Landlord had acted in bad faith by not occupying the unit for the required one-year period, remains unchanged and in full effect.
