What happened

Tenant applied for an order determining that Landlord failed to meet maintenance obligations under the Residential Tenancies Act, 2006. The shower enclosure in the rental unit had issues with tiles falling off the wall, water damage, and mold. The Landlord took an unreasonable amount of time to complete the necessary repairs.

The ruling

The Landlord failed to meet their maintenance obligations under the Residential Tenancies Act, 2006. The Landlord must pay the Tenant $2,647.80 and complete the work on the shower enclosure by December 1, 2024. If the Landlord does not complete the work by the deadline, the Tenant is authorized to arrange for the work to be done and deduct the cost from the rent.
