What happened
The Landlord applied for eviction due to non-payment of rent. An initial hearing was adjourned because the Tenant was ill. An interim order required the Tenant to pay new rent on time; however, the Tenant failed to have funds in her account by the 1st of the month. Consequently, the Member refused to hear the Tenant's section 82 maintenance and harassment claims. The Tenant, a DJ who recently started a sales job, sought a payment plan, but the Member determined her income was not sufficiently established to sustain the tenancy.
The ruling
The tenancy is terminated effective September 30, 2025, unless the Tenant voids the order by paying $10,916.76 by August 31, 2025, or $12,719.91 by September 30, 2025. If the Tenant does not void, she must vacate by September 30, 2025, and pay the Landlord $5,648.04 plus daily compensation of $59.28 from July 3, 2025.
