What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. By the time of the hearing, the Tenant had already vacated the rental unit. The primary issue during the hearing involved the Tenant's attempt to raise Section 82 issues (maintenance or other tenant-initiated issues) without having provided the required 7-day advance disclosure to the Landlord. The Adjudicator denied the request to hear those issues to ensure procedural fairness to the Landlord.
The ruling
The tenancy is terminated effective June 30, 2025. The Tenant is ordered to pay the Landlord $3,847.83 by September 30, 2025. This amount accounts for rent arrears and the application fee, minus the last month's rent deposit and accrued interest. The Tenant's request to raise maintenance issues was denied due to lack of disclosure, though the Tenant retains the right to file a separate application.
