What happened
The Landlord filed an application to terminate the tenancy and evict the Tenants for non-payment of rent. A valid N4 Notice was served, which the Tenants failed to void. One of the Tenants attended the hearing, acknowledged the arrears, and requested a payment plan or a delay in eviction. The Board denied these requests, finding a payment plan not viable due to the Tenants' financial deficit and a delay unreasonable and prejudicial to the Landlord given the substantial and growing arrears.
The ruling
The tenancy is terminated unless the Tenants pay the Landlord $27,717.33 by April 26, 2025. If they fail to pay, the Tenants must vacate the unit by April 26, 2025, and pay the Landlord $24,239.58, which includes rent arrears and the application fee, less the rent deposit and interest. The Tenants will also owe daily compensation of $57.50 from April 1, 2025, until they move out.
