What happened
Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant substantially interfering with the Landlord's lawful rights. The Landlord alleged that the Tenant was stealing hydro by running an extension cord from the rental unit to the hallway of the rental complex after Brantford Power disconnected the hydro to the rental unit for non-payment of bills.
The ruling
The Landlord proved the Tenant substantially interfered with the Landlord's lawful rights by stealing hydro. However, the Tribunal granted relief from eviction subject to the Tenant complying with conditions to not use extension cords outside the rental unit and pay the Landlord's application costs. If the Tenant fails to comply, the Landlord can apply to terminate the tenancy without notice.
