What happened

The Landlord applied to terminate the tenancy and evict the Tenants for breaching a condition of a previous LTB order (LTB-L-027440-24). An ex-parte order (LTB-L-008011-25) was issued on February 7, 2025. The Tenants subsequently filed a motion to set aside that order. During the motion hearing, the parties reached a consent agreement to set aside the eviction and establish new payment conditions.

The ruling

The LTB granted the Tenants' motion to set aside a previous eviction order based on a consent agreement. The eviction is halted, and the previous order from September 2024 is replaced. The Tenants are required to pay their rent in full and on time for a period of one year (May 1, 2025, to April 30, 2026). If the Tenants fail to make any payment on time, the Landlord can apply for an eviction order without further notice to the Tenants.
