What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant because the rental unit is the superintendent's premises and the Tenant's employment has ended. The Tenant remained in the unit beyond the one-week grace period provided by the Act after his employment was terminated on July 16, 2025.

The ruling

The LTB terminated the tenancy effective July 16, 2025. The Tenant is ordered to move out by October 15, 2025. The Landlord's claim for per diem compensation was denied as the Act does not provide for it in superintendent's premises applications under Section 94. The Tenant must pay the Landlord $186.00 for the application filing fee.
