What happened

The Tenant applied for an order determining that the Landlord illegally retained $600 of a $1,600 rent payment sent from ODSP on behalf of the Tenant. The Tenant also claimed the Landlord did not use the last month's rent deposit to pay for the last rental period and did not return the deposit.

The ruling

The Landlord's retention of $2,200 was in contravention of the Act. The Tenant is owed $800 for half a month's rent in January 2023 and $600 for remaining rent monies paid by ODSP, to be deducted from the last month's rent deposit.
