What happened

The Landlord applied for eviction after the Tenant failed to meet conditions set in a previous LTB order regarding rent arrears. An order was issued without a hearing on July 7, 2025, which the Tenant moved to set aside. The Tenant admitted to missing payments, citing a disruption in financial assistance from adult children and personal health issues. The Tenant proposed a 55-month repayment plan, which the Landlord contested as unreasonable given the high amount of arrears and the Tenant's limited income.

The ruling

The Tenant's motion to set aside the eviction order was denied. The LTB found that the Tenant breached a prior repayment condition and that the tenancy was no longer financially viable, with arrears exceeding $11,000. While the eviction order stands, the Board granted a stay until September 30, 2025, to accommodate the Tenant's health issues and the application of an existing rent deposit.
