What happened
The Landlord applied for eviction and termination of tenancy due to significant rent arrears. The Tenant claimed to have made cash payments for several months that the Landlord disputed, and also raised maintenance issues regarding a boarded-up basement window as a reason for eventually stopping payments. The LTB found the Landlord's testimony regarding the non-payment more credible due to a lack of documentary evidence from the Tenant.
The ruling
The tenancy is terminated effective August 15, 2025, unless the Tenant voids the order by paying the full arrears and filing fee (approximately $6,786.00 by July 31, 2025). The Tenant is ordered to pay $5,484.14 in total arrears up to the hearing date, after deducting the rent deposit and interest, plus daily compensation of $19.73 until the unit is vacated.
