What happened
The Landlord applied to terminate the tenancy due to non-payment of rent. An initial order was issued in the Tenants' absence, which the Tenants sought to review, claiming they missed the hearing due to stress and sleep deprivation caused by a bedbug infestation. The Board granted the review. The Tenants raised maintenance issues regarding bedbugs and a rat-infested garage under section 82. The Adjudicator found that while the Landlord acted reasonably regarding the bedbugs, there was a failure to maintain the garage, resulting in a nominal rent abatement. However, the massive rent arrears outweighed the maintenance claims, leading to a termination order.
The ruling
The LTB granted the review and replaced the previous order. The tenancy is terminated effective July 15, 2025, due to significant rent arrears ($21,400.00). The Tenants were awarded a $100.00 abatement for a rat infestation in the garage. To void the eviction, the Tenants must pay $21,486.00 by June 30, 2025, or $24,286.00 by July 15, 2025. If they do not void, they owe the Landlord $11,463.08 after applying the rent deposit and abatement. The Landlord is also ordered to treat the unit for bedbugs and rats by July 31, 2025.
