What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent and persistent late payment of rent. The Landlord served valid N4 and N8 notices, but the Tenant did not void the notices by paying the arrears.

The ruling

The tenancy is terminated unless the Tenant pays $9,866 by May 14, 2023 to void the order. If the Tenant does not pay, the Tenant must move out by May 14, 2023 and pay $8,750.40 in rent arrears and application costs. The Tenant must also pay $26.30 per day in compensation for occupying the unit after the hearing date.
