What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The Landlord served valid N4 and N8 notices, which the Tenants did not void by paying the arrears. The Tenants were still in possession of the rental unit at the time of the hearing.

The ruling

The tenancy is terminated effective March 9, 2024. The Tenants must pay the Landlord $28,706.67, which includes rent arrears and the application filing fee, minus any amounts the Landlord owes the Tenants. If the Tenants do not vacate by March 9, 2024, the Landlord can file the order with the Sheriff to enforce the eviction. The Tenants will also owe daily compensation of $69.91 for each day of occupation after December 19, 2023.
