What happened

The Landlords applied to terminate the tenancy due to substantial rent arrears. A previous order was issued in August 2025, which the Tenants sought to review after missing the initial hearing. The LTB granted the review, hearing the case de novo. Tenant 1 admitted to the arrears, which totaled over $21,000.00, but proposed a payment plan based on a new job and potential RRSP withdrawal. The Board found the proposed plan unreasonable given the length of time without payment and lack of evidence for income, resulting in a termination order with a delayed eviction date to allow the Tenants to void by paying the full balance.

The ruling

The LTB terminated the tenancy effective November 30, 2025, unless the Tenants pay $24,244.00 by October 31, 2025, or $27,244.00 by November 30, 2025, to void the order. If the Tenants do not void the order, they must vacate by November 30, 2025, and pay the Landlords $16,686.98 for arrears up to the hearing date plus daily compensation of $98.63 until they move out.
