What happened
The Co-op (Landlord) applied to evict the Co-op Member (Tenant) for seriously impairing the safety of other residents. The Tenant was absent from the hearing and was deemed to have accepted all allegations. The Board heard uncontested evidence of multiple violent and threatening incidents, including the Tenant swinging a hammer in a playground, threatening a child, patrolling hallways with a baseball bat, threatening to slit a child's throat, and threatening another child with a butcher knife. The Co-op's attempts to accommodate potential mental health issues were unsuccessful as the Tenant did not cooperate.
The ruling
The Co-op Member's occupancy is terminated, and an expedited eviction is ordered for June 27, 2025. The decision is based on the Member's severe and ongoing threatening behavior, which seriously impaired the safety of other residents. Relief from eviction was denied. The Member must pay the Co-op a daily compensation of $31.40 starting June 12, 2025, until they vacate, plus the $186.00 application fee, less a $600.00 refundable deposit.
