What happened

The landlords appealed a decision of the Landlord and Tenant Board (LTB) which found that there was an agreement to terminate the tenancy. The LTB had ruled that the landlords interfered with the tenants' reasonable enjoyment of the property by unilaterally rescinding that agreement.

The ruling

The Divisional Court dismissed the landlords' appeal, finding no error of law in the LTB's decision. The court upheld the LTB's finding that there was an agreement to terminate the tenancy based on the exchange of emails between the parties.
