What happened

The Landlords applied for an order to terminate the tenancy and evict the Tenants due to significant rent arrears. The Landlords also initially applied for termination based on illegal acts but withdrew that application (L2) during the hearing. The Tenants had been in the unit since March 2023. At the hearing, the primary dispute concerned a partial payment for August 2024. The Tenant claimed to have paid in full but could not provide evidence. The Landlord cited severe financial strain, including the necessity of a second mortgage to maintain the property because of the missing rent payments.

The ruling

The tenancy is terminated effective April 28, 2025. The Tenants are ordered to pay $22,351.91 to the Landlord to cover rent arrears up to the hearing date and the filing fee, after deducting the rent deposit and interest. To void the eviction and continue the tenancy, the Tenants must pay a total of $27,936.00 by April 28, 2025.
