What happened
The Landlords applied for an order to terminate the tenancy for personal occupation. They served an N12 notice with a termination date of July 31, 2025. However, the mandatory one-month rent compensation was not paid to the Tenants until August 4, 2025, four days after the statutory deadline. As a result, the application was dismissed for non-compliance with the Act.
The ruling
The Landlords' application for termination and eviction based on an N12 notice is dismissed because the required compensation was paid four days after the legal deadline. The Tenants are ordered to return the $3,000.00 compensation payment to the Landlords by December 19, 2025.
