What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to substantial rent arrears. The Tenant sought an adjournment for medical reasons and to allow his representative access to the Tribunals Ontario Portal, both of which were denied. The Tenant also moved to dismiss the application based on the service of the N4 notice via email, which was also denied as the Member found the Tenant was aware of the notice.
The ruling
The tenancy is terminated unless the Tenant pays $18,536.00 by July 22, 2025, to void the order. If not voided, the Tenant must vacate by July 22, 2025, and pay the Landlord $11,915.04 plus daily compensation of $70.68 until they move out.
