What happened

The Landlords applied for termination of tenancy and eviction due to non-payment of rent. The Tenant, who has lived in the unit since 2008, accumulated substantial arrears exceeding $19,000. The Tenant's representative argued that cash payments were made during the pandemic which were not accounted for, but provided no evidence. The Tenant also suggested a nominal payment plan of $300 per month, which was rejected as unreasonable given the scale of the debt.

The ruling

The tenancy is terminated effective September 30, 2025. The Tenant is ordered to pay $16,722.16 to the Landlord, accounting for arrears, the application fee, and deducting the rent deposit and interest. To void the eviction and continue the tenancy, the Tenant must pay $21,391.92 by September 30, 2025. Daily compensation of $66.40 applies for each day the Tenant remains in the unit after August 28, 2025.
