What happened
The Tenant filed an application alleging illegal entry, harassment, and substantial interference with reasonable enjoyment. The primary issues concerned multiple entries for showings after an N9 notice was served. Specifically, the Tenant alleged that a Landlord's agent entered the unit while she was sleeping to take marketing photographs without consent, and subsequently distributed those photographs (which included the Tenant in bed under a duvet) to prospective tenants.
The ruling
The Landlord is ordered to pay the Tenant $1,048.00 by December 6, 2025. This includes $1,000.00 in general damages for the illegal entry and privacy breach occurring on June 30, 2024, plus the $48.00 filing fee. The Board found that while most entries for showings were acceptable, the entry to take marketing photos while the tenant was asleep and the subsequent distribution of those photos was a serious violation of the Tenant's rights.
