What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit as of the hearing date.

The ruling

The tenancy will be terminated on May 31, 2023 unless the Tenant pays $262 by April 30, 2023 or $421 by May 31, 2023 to void the order. The Landlord owes the Tenant $149.16 for the rent deposit and interest, but can deduct $5.23 per day for compensation starting April 14, 2023 until the Tenant moves out.
