What happened
The Landlord filed an application for non-payment of rent against three individuals. At the hearing, it was determined they were not in a joint tenancy. The Landlord was permitted to amend the application to proceed against only one Tenant, Jason Adomako. The Tenant was absent from the hearing. The Board found the N4 notice to be valid and ordered the tenancy terminated unless the Tenant pays the outstanding arrears.
The ruling
The tenancy is conditionally terminated. The Tenant can void the order by paying $18,386.00 by May 31, 2025, or $19,686.00 by June 8, 2025. If the payment is not made, the Tenant must vacate by June 8, 2025, and owes the Landlord $17,983.54 plus daily compensation of $42.74 from May 22, 2025, until move-out. The Landlord's application was amended to proceed against only one tenant due to a procedural error.
