What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants Jayde Norrish and Faith Beckon had vacated the rental unit in January 2023, and Cameron Erskine had vacated in May 2023, but they did not inform the landlord in writing.
The ruling
The Board granted the landlord's application for rent arrears of $14,186, but denied the eviction order due to the landlord's serious breach of the maintenance obligations by not providing the tenants with access to a working shower. The Board ordered the tenants to pay the arrears in installments over 12 months, with interest payable on any missed payments.
