What happened
The Landlord initially applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. Following an order issued on May 30, 2025, the Tenant requested a review, claiming a serious error occurred. The Tenant specifically challenged the eviction date. The Board reviewed the request and determined that the original adjudicator properly considered the Tenant's circumstances, including the Tenant being on a waiting list for subsidized housing for ten years, and used discretion to postpone the eviction/voiding date to August 31, 2025.
The ruling
The request for a review of the order dated May 30, 2025, is denied. The Board confirmed that the original order was procedurally fair and legally sound. The Tenant remains ordered to pay the arrears or vacate the unit by August 31, 2025. Any payments made by the Tenant after April 16, 2025, must be credited by the Landlord.
