What happened

The Landlords applied to terminate the tenancy and evict the Tenants because of substantial rent arrears. The Tenants had not paid any rent since January 2025. Despite having a combined income of approximately $4000 per month from EI and sick leave, the Tenants could not explain why no payments were made and were unable to commit to a repayment plan. The Landlords, individuals who rely on the rent for mortgage and taxes, sought possession of the unit.

The ruling

The tenancy is terminated effective July 31, 2025. To void the eviction, the Tenants must pay $10,736.00 by July 31, 2025. If they do not pay and do not move out, the Landlords can enforce the eviction through the Sheriff starting August 1, 2025. If the tenancy is terminated, the Tenants are ordered to pay the Landlords $6,896.68 plus daily compensation of $57.53 until they vacate.
