What happened

The landlord applied for an order to terminate the tenancy and evict the tenant due to the tenant's failure to meet a condition specified in a previous order issued by the LTB on October 17, 2022. The tenant failed to pay $930 towards the arrears by February 20, 2023 and failed to pay the lawful rent by March 1, 2023.

The ruling

The tenancy is terminated effective May 9, 2023. The tenant must pay the landlord $9,846.76 (less any payments made after March 10, 2023) for rent arrears up to April 28, 2023, plus $39.72 per day for compensation for use of the unit starting April 29, 2023 until the tenant moves out. If the tenant does not pay the full amount by May 9, 2023, the tenant will owe interest at 6% annually on the outstanding balance.
