What happened
Tenant applied for an order determining that the Landlord collected or retained money illegally. The Tenant claimed the Landlord retained the Tenant's rent deposit of $699.00 collected on July 31, 2024. The Tenant gave notice to terminate the tenancy by January 31, 2024 and requested to assign the tenancy to Blessing, who moved in on February 1, 2024. The Landlord deducted amounts from the deposit and only returned $200.00 to the Tenant.
The ruling
The Landlord must pay the Tenant $547.00, which includes the remaining $499.00 of the rent deposit and the $48.00 application fee. The Landlord is not entitled to deduct from the deposit for loss of rental income from the other tenant's room or the cost of replacing the other tenant's bedding.
