What happened

The Landlord applied to terminate the tenancy and evict the Tenant due to non-payment of rent and NSF cheque charges. The Tenant failed to attend the hearing despite being properly served. The Landlord provided evidence of rent arrears and administrative charges incurred due to returned cheques. Although the Tenant made some payments after the application was filed, a balance remained outstanding.

The ruling

The tenancy is terminated unless the Tenant pays $2,211.86 on or before September 30, 2025, or $3,204.78 on or before October 3, 2025, to void the order. If the order is not voided, the Tenant must vacate by October 3, 2025, and pay the Landlord $868.64 plus daily compensation of $32.64 from September 18, 2025, until move-out.
