What happened

Landlord applied to terminate the tenancy and evict the Tenant due to substantial interference with the reasonable enjoyment of the residential complex, willful or negligent damage to the premises, and the Tenant or another occupant committing an illegal act in the rental unit or residential complex.

The ruling

The Landlord's application to terminate the tenancy and evict the Tenant is granted, but the Tenant is granted conditional relief from eviction. The tenancy will continue if the Tenant maintains sufficient ordinary cleanliness of the unit to ensure strong smells of cigarette smoke, urine, and feces do not emanate from the unit for 24 months. The Tenant is also ordered to obtain the Landlord's consent before installing and using any camera in the common areas of the residential complex.
