What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to rent arrears. The Tenant was served with an N4 notice but failed to pay the arrears before the application was filed. Despite paying $2,400 after the application filing, the Tenant still owed arrears. The Tenant did not attend the hearing.
The ruling
The tenancy is terminated effective July 15, 2025, unless the Tenant pays $1,386.00 to void the order. This amount includes rent arrears and the application fee, minus payments made after filing. If the Tenant moves out, the Landlord actually owes the Tenant $19.12 because the last month's rent deposit and interest exceed the arrears and filing fee as of the hearing date. Daily compensation of $19.73 applies from June 24, 2025.
