What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants alleging persistent late payment of rent. However, upon review of the Notice to End a Tenancy at the End of the Term (N8), the Board found that the termination date provided was legally deficient as it did not match the last day of the rental period.

The ruling

The application filed by the Landlord to terminate the tenancy for persistent late payment is dismissed. The Landlord served an N8 notice that contained an incorrect termination date, failing to comply with the requirements of the Residential Tenancies Act, 2006. Consequently, the Board lacked the authority to grant the eviction.
